Halpern May Ybarra Gelberg LLP partner A. Carley Palmer has successfully persuaded the California Court of Appeal (Second Appellate District) to reverse a trial court’s denial of an HMYG client’s petition for arbitration. Ms. Palmer represented the client in a partnership dispute, after a trial court declined to enforce the partnership agreement’s arbitration clause, citing procedural grounds. Working with co-counsel Judah Ariel at Ariel Law (of Washington, D.C.), Ms. Palmer co-authored the appellate briefs and argued the appeal, ultimately convincing all three justices to issue a unanimous ruling reversing the lower court’s decision and remanding with instructions that the trial court consider the client’s arguments in support of arbitration.
