Halpern May Ybarra Gelberg Secures Complete Dismissal of Criminal Charges for Its Client

Halpern May attorneys Grant B. Gelberg, A. Carley Palmer, and Catherine Thompson have obtained the pre-trial dismissal of all criminal charges brought by the San Bernardino County District Attorney’s Office against the firm’s client.  The client, an employee of a logistics company, had been charged with multiple felonies based on allegations of selling counterfeit goods.  Through aggressive discovery into the prosecution’s case, Halpern May uncovered that critical investigatory steps were conducted not by law enforcement officers, but rather by private investigators hired by a private company whose goods had allegedly been counterfeited, and from whom no discovery had been produced.  In preparation for the client’s preliminary hearing, Halpern May brought multiple discovery motions to obtain exculpatory and impeachment evidence from the private investigators and private company.  Rather than oppose those motions or face further scrutiny of its investigation, the prosecution elected to dismiss all charges and abandon its pursuit of Halpern May’s client—all before any preliminary hearing was held.
