Halpern May Ybarra Gelberg LLP attorneys Aaron May, Joseph Ybarra, Thomas Rubinsky, and Abigail Marion have obtained a $1.34 billion arbitration award on behalf of Laguna Beach businessman Mohammad Honarkar and his company, 4G Wireless, Inc. The award, which represents one of the largest known fraud-based arbitration awards involving a Southern California commercial real estate portfolio, found respondents liable for fraudulent inducement, breach of contract, forcible entry and detainer, and related claims, all arising from a joint venture that took control of numerous commercial properties previously owned by firm clients Honarkar and 4G Wireless. The award of more than a billion dollars, which includes punitive damages, was made after nearly three years of proceedings—during which the firm first secured an arbitration victory on the merits and further succeeded in having that merits ruling (along with an attorneys’ fees and costs award) confirmed in court.
