Halpern May Ybarra Gelberg LLP Wins Complete Dismissal of Charges in Health Care Fraud Prosecution

After two lengthy evidentiary hearings, Halpern May Ybarra Gelberg won a complete dismissal of all charges against Dr. Andrew Jarminski, a defendant in a 17-defendant, $300 million health care fraud prosecution in Orange County, California.
Firm Partners Grant Gelberg and Aaron May, and Attorney Joel Mallord, led the defense of Dr. Jarminski.  Serving as lead counsel, Mr. Gelberg cross-examined numerous witnesses at the evidentiary hearing, establishing that the prosecution and its investigators repeatedly invaded the attorney-client privilege.  Following extensive post-hearing briefing, the Court ruled that the prosecution’s case could not proceed and all charges against Dr. Jarminski were dismissed.
